Terms and Conditions

Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the https://www.emilynutritioncoach.co.uk website and Coaching Packages “Service” operated by My Company (AW Personal Training and Nutrition) (“I”, “us”,”we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

Purchases

If you wish to purchase any product or service made available through the Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation: your age, contact details, information about your health and health conditions of your immediate family members.

Subscriptions

The online coaching Service is billed on a subscription basis (“Subscription(s)”). You will be billed in advance and asked to set up a standing order on a recurring monthly basis. Minimum sign up period of 2 months applies to “online coaching”. After your minimum commitment period expires, your subscription will be charged via standing order on a monthly, reoccurring basis until you chose to cancel the standing order.

If you cancel your standing order subscription, you may use your subscription until the end of your then-current subscription term and your subscription. You won’t be eligible for a prorated refund of any portion of the subscription fee paid for the then-current subscription period.

To cancel your subscription after the minimum sign up period, please first notify myself (Emily Wilkinson) via email emily@awmuscleandfitness.com. The person who made the original bill payment is responsible for arranging payment cancellation through the standing order.

If a payment is taken due to you not cancelling the standing order on time, then a refund will not be available and you.

The 6-week programme is not a subscription. You will be billed in advance and asked to pay via BACS. You must complete the package within a 90-day period. Failure to do so will not result in any refund given.

Commercial use prohibited

The Service is for your personal use only and may not be used in connection with any commercial endeavours. Organizations, companies, and/or businesses may not join and use the Service for any purpose.

Access and proprietary rights
So long as you comply with these Terms of Use, you are authorized to access, use, and make a limited number of copies of information and materials made available to you through the Service only for purposes of your personal use. Any copies of material made by you must retain without modification any and all copyright notices and other proprietary marks. The personalised plans and content made available to you may not be copied, distributed, modified, published, or transmitted in any other manner, including use for creative work or to sell or promote other products. Violation of this restriction may result in infringement of intellectual property and contractual rights of Emily Wilkinson or third parties which is prohibited by law and could result in substantial civil and criminal penalties.

Our Service may contain links to third-party web sites or services that are not owned or controlled by Emily Wilkinson

Emily Wilkinson has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that Emily Wilkinson shall not be responsible or liable, directly, or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Termination
You agree that I may, without prior notice, immediately terminate, limit your access to or suspend your “Service”. Cause for such termination, limitation of access or suspension shall include, but not be limited to, (a) breaches or violations of the Terms or other incorporated agreements or guidelines, (b) discontinuance or material modification to the “Service” (or any part thereof), (c) unexpected technical or security issues or problems, (d) engagement by you in fraudulent or illegal activities, and/or (e) non-payment of any fees owed by you in connection with the Services. Further, you agree that all terminations, limitations of access and suspensions for cause shall be made in my sole discretion and that I shall not be liable to you or any third party for any termination of your Package or suspension/removal from the Group.
